1. Introduction
These Terms of Use govern your use of tinyPNG.App (“the App”), developed by Between Elements. The App provides a graphical user interface (GUI) for TinyPNG’s image compression API. By accessing or using the App, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Services Provided
The App acts as a front-end interface for TinyPNG’s API, allowing users to compress images. The App does not host, control, or own the TinyPNG API or its services. All image compression is performed by TinyPNG’s servers, and the limitations, quality, and availability of the compression services are subject to TinyPNG’s terms and conditions.

3. API Keys and Subscription
Users are required to obtain an API key from TinyPNG.com to use the compression services through the App. TinyPNG offers both free and paid API keys. The App does not manage or handle subscription services, payment processing, or API key distribution. All subscription and payment processes are managed directly by TinyPNG.

4. Limitations and Disclaimer

• The App is provided “as is,” and Between Elements makes no warranties or representations about the App’s functionality, performance, or compatibility with TinyPNG’s API.
• Between Elements is not responsible for any limitations, downtimes, or service disruptions caused by TinyPNG.
• Users acknowledge that they are solely responsible for complying with TinyPNG’s Terms of Service when using their API.

5. User Responsibilities

• Users must not use the App in any way that could harm or disrupt TinyPNG’s services.
• Users are responsible for maintaining the security of their API keys and must not share or misuse them.
• Users agree not to use the App for illegal, harmful, or prohibited purposes.

6. Intellectual Property

• The App and its associated content, excluding TinyPNG’s API, are the intellectual property of Between Elements and are protected by applicable copyright and trademark laws.
• All third-party trademarks, service marks, and logos used in the App are the property of their respective owners, including TinyPNG.

7. Limitation of Liability
Between Elements shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages, arising from or related to the use of the App or TinyPNG’s services.

8. Changes to the Terms
Between Elements reserves the right to modify these Terms of Use at any time. Any changes will be posted on the App’s website, and your continued use of the App constitutes acceptance of the revised terms.
